Czechia Becomes Latest European Country to Legalise Cannabis

On the first day of 2026, Czechia became the newest European nation to legalise cannabis for adult recreational use. Adults can now legally possess up to 25 grams in public and cultivate up to five plants at home. The shift makes Czechia one of a growing number of European countries moving away from prohibition and toward a regulated, health-led approach.

A Continent Shifting

Germany led the way in Europe with its landmark Cannabisgesetz in 2024, which allowed personal possession and the formation of non-profit social clubs for cultivation and distribution. By mid-2026, over 400 clubs had received licences across Germany, with the first legal harvests distributed to members in late 2024. Progress has been uneven — conservative-led states like Bavaria dragged their feet — but the direction of travel is clear.

Slovenia introduced its Medical and Scientific Cannabis Act in August 2025, allowing doctors to prescribe cannabis based on professional judgement and issuing medical cannabis cards to protect patients from police harassment. The Netherlands and Switzerland are both due to release the results of their regulated supply pilot programmes in late 2026.

What It Means for Ireland

The movement across Europe puts pressure on Ireland and Northern Ireland, where cannabis remains fully criminalised for recreational use. The Republic's Joint Oireachtas Committee on Drugs Use published its final report in June 2026, recommending full decriminalisation of possession for personal use. A new Health Referral Scheme is due to launch in September 2026, allowing Gardaí to refer individuals found with drugs to the HSE rather than to the courts.

Northern Ireland, governed by Stormont, mirrors UK-wide policy. Reform is not on the immediate legislative agenda. Medical cannabis has been legal across the UK since 2018, but NHS prescriptions remain extremely rare, and most patients must access treatment through private clinics at significant personal cost.

The direction of travel across Europe is unmistakable. The question for these islands is how long they wait to follow.
